O surgimento da linguagem dos direitos na modernidade e seus críticos

Abstract

Este trabalho propõe uma busca pelo surgimento da linguagem dos direitos subjetivos para posteriormente defendê-los frente às críticas que lhes são feitas no século XX. Para isso é feita uma análise da evolução do pensamento anti-heroico no século XVII que culmina na concepção da igualdade natural de todos os homens, conceito necessário para que lhes seja atribuída a condição de sujeitos de direitos. Este processo do pensamento anti-heroico é representado por diversas perspectivas, tendo sido eleitas para mostrar este processo gradativo: a dramaturgia de Pierre Corneille, os pensamentos de Baltasar Gracián, a filosofia política de Thomas Hobbes e a teologia Jansenista. Em seguida são expostos os argumentos dos críticos antiliberais, como Carl Schmitt e Michel Villey, sobre a forma abstrata e impessoal que tomaram dos direitos subjetivos, acusando o pensamento dos séculos precedentes de, a partir de sua concepção do homem como livre e igual e sua concretização na forma dos direitos subjetivos, provocar uma “atomização” da sociedade. O que emerge dessa análise é uma objeção ao argumento antiliberal, tendo em vista sua proposta incoerente, a saber, de um direito concreto e pessoal em oposição aos direitos subjetivos.

This paper searches for the beginning of the subjective rights discourse to latter defend it against the critics that have arised in the twentieth century. With that in mind, an analysis was made in the evolution of an anti heroic thought which took place in the seventeenth century, and latter, made room to the conception of the natural equality of all men which is necessary to comprehend him as a right holder. This growth of the anti heroic thought is possible to identify under numerous different perspectives, the ones that have been chosen were: the dramaturgy of Pierre Corneille, the thoughts of Baltasar Gracián, the political philosophy of Thomas Hobbes and the theological philosophy of the Jansenistas. Afterwards, the purpose is to show the objections of the antiliberal critics, such as Carl Schmitt and Michel Villey, in the matters of the abstraction and impersonality, both features of the subjective rights. This critics ended up addressing all the guilt to the precedent centuries, where the conception of man as free and equal was conceived, as its’ materialization in the form of the subjective rights, blaming the liberals for the atomization of society. What emerges from this study is an objection to the antiliberal arguments, aiming to present how unreliable can be the form of rights defended by them, a right which is concrete and personal as an opposition to the subjective rights.
