Este trabalho explora o problema da devolução pelos pretendentes de crianças e adolescentes que estão em estágio de convivência às instituições de acolhimento. Para a construção do entendimento, faz-se uma breve análise sobre os direitos das crianças e adolescente, em especial o direito à convivência e ao respeito à inviolabilidade da integridade psicofísica dos menores e elucida a influência da doutrina da proteção integral e do melhor interesse da criança. Em seguida explora o instituto da responsabilidade civil e sua aplicabilidade ao direito de família, especificamente as relações familiares. A partir dessas compreensões esquadrinha a possibilidade de incidência de responsabilização civil dos pretendentes à adoção que desistem do processo durante o estágio de convivência com crianças e adolescentes pela prática de ato ilícito civil ou por abuso de direito. Para a verdadeira problematização, valeu-se de artigos científicos da área da psicologia e psiquiatria para o reconhecimento dos possíveis danos psicológicos aos menores devolvidos. Ao fim, conclui-se que para uma correta prestação jurisdicional deve considerar toda a construção do direito da criança e do adolescente e a incidência ou não da responsabilidade civil só deve ser decidia tendo em vista a condição especial de pessoa em desenvolvimento que o menor tem. ...

It then explores the institute of civil liability and its applicability to family law, specifically family relations. From these understandings it examines the possibility of incidence of civil liability of the adoption applicants who give up the process during the coexistence stage with children and adolescents for the practice of civil illicit act or for abuse of rights. For the real problematization, it used scientific articles from the area of psychology and psychiatry to recognize the possible psychological damage to the returned minors. In the end, it is concluded that for the correct judicial provision the whole construction of the rights of the child and adolescent must be considered and the incidence or not of the civil liability should only be decided in view of the special condition of developing person that the minor has. ...
