O impacto da tecnologia blockchain no registro imobiliário

Abstract

Este trabalho tem por objetivo analisar a possibilidade de aplicação da tecnologia blockchain no sistema de registro imobiliário brasileiro a partir da teoria ponteana do fato jurídico no escopo do plano da validade e dos princípios norteadores da legislação específica ao tema. Para este estudo, foi a metodologia qualitativa descritiva contemplando a revisão bibliográfica sobre o tema. Na primeira parte do trabalho é apresentado o histórico e conceitos fundamentais do sistema registral brasileiro e sobre a tecnologia blockchain. Posteriormente são realizadas análises dos sistemas à luz do plano da validade, a apresentação de estudos de casos da aplicação da tecnologia blockchain, a comparação deste em relação ao sistema de registro Torrens. Por fim é apresentada uma análise de aderência da tecnologia aos princípios norteadores da legislação aplicada ao registro de imóveis no Brasil.

This work aims to analyze the possibility of applying blockchain technology in the Brazilian real estate registration system from the point of view of the legal fact within the scope of the validity plan and the guiding principles of specific legislation to the theme. For this study, it was the descriptive qualitative methodology contemplating the bibliographic review on the topic. In the first part of the work, the history and fundamental concepts of the Brazilian registration system and the blockchain technology are presented, the presentation of case studies of the application of blockchain technology, the comparison of this in relation to the Torrens registration system. Finally, an analysis of the technology's adherence to the guiding principles of the legislation applied to property registration in Brazil is presented.
