Em decorrência do aumento do número de casos de devolução de crianças e adolescentes após o final do processo de adoção ou durante sua tramitação, ganha força a necessidade de analisar a responsabilidade civil resultante dos danos imateriais gerados por esta conduta. Tal análise, recorreu à investigação do papel da adoção na sociedade e no direito contemporâneo, e também da compreensão dos princípios constitucionais que estendem-se no Direito de Família e dos direitos e garantias que protegem as crianças e os adolescentes. Dessa forma, foi indispensável o exame do instituto da responsabilidade civil e a compreensão dos requisitos que configuram o dever de indenizar o dano moral sofrido pelas crianças e adolescentes devolvidas durante ou após o processo de adoção. O presente traballho buscou, através da pesquisa bibliográfica, apresentar os fatores processuais e psicossociais que causam ou auxiliam para a desistência do processo de adoção. Juntamente com a análise dos estudos doutrinários, este trabalho também buscou investigar as decisões judiciais que trataram do tema, para compreender quais entendimentos estão sendo considerados pelo Poder Judiciário. Due to the increase in the number of cases of return of children and adolescents after the end of the adoption process or while it is being processed, the need to analyze the civil liability resulting from the immaterial damages generated by this conduct gains strength. Such analysis appealed to the investigation of the role of adoption in society and in contemporary law, and also the understanding of the constitutional principles that extend to Family Law and the rights and guarantees that protect children and adolescents. Thus, it was essential to examine the institute of civil liability and understand the requirements that configure the duty to indemnify the moral damage suffered by children and adolescents. The present work sought, through bibliographical research, to present the procedural and psychosocial factors that cause or help to give up on the adoption process. Along with the analysis of doctrinal studies, this work also sought to investigate the court decisions that dealt with the issue, in order to understand which understandings are being considered by the Judiciary.
