A possibilidade de direitos e deveres oriundos da relação afetiva entre padrasto, madrasta e enteado/a

Abstract

O presente trabalho tem o objetivo de tratar das possibilidades jurídicas que decorrem a partir da relação de padrastio e madrastio. Nesse viés, iniciamos a monografia tratando das famílias reconstituídas, abordando a sua estrutura e a possibilidade de surgimento da figura do padrasto e da madrasta a partir de tais relacionamentos. A seguir, abordaremos o instituto da multiparentalidade e suas características e formas de constituição. Ao final, levantaremos os possíveis efeitos jurídicos decorrentes da parentalidade socioafetiva, realizando a separação entre aqueles que surgem em virtude do estado de posse de filho e os que surgem da relação entre padrasto, madrasta e enteado(a).

The present study has the objective of dealing with the juridical possibilities that arise from the relation of step-father and step-mother. In this bias, we began our monograph dealing with reconstituted families their structure and the possibility of the emergence of the figure of stepfather and stepmother from such relationships. Next, we will approach the institute of multiparentality and its characteristics and forms of constitution. At the end, we will raise the possible legal effects of socio-affective parenting, separating effects arising from the state of child ownership and those arising from the relationship between stepparent and stepchild.
