A legitimidade do estado republicano de Immanuel Kant

Abstract

A presente monografia busca compreender a concepção singular de Immanuel Kant sobre o sistema de governo republicano, suas características, atribuições, operação e, em especial, seus fundamentos de legitimidade. O caminho expositivo optado é o da reconstrução didática do projeto racional kantiano, a partir do qual são analisados, desde sua formação, os conceitos jurídico-políticos que culminam na configuração estatal propícia ao desenvolvimento adequado do Estado e de seus poderes. Aborda-se, portanto, desde o exame do indivíduo à parte do Estado, ou seja, as questões atinentes a direitos naturais e ao projeto de formação de um povo, até a sua concretização, com a dedução dos princípios que embasarão o sistema jurídico e delinearão suas instituições. Ao final do trabalho, são propostos quatro fatores fundamentais à legitimidade da república, nomeadamente, i.) a liberdade do homem como direito natural; ii.) a obrigação moral do homem de organizar-se em um Estado; iii.) o estabelecimento de um Estado de Direito; e iv) a conformidade do direito positivo com o direito natural.

This monograph seeks to understand Immanuel Kant‟s unique conception of the republican system of government, its characteristics, attributions, operation and, in particular, its foundations of legitimacy. The chosen expository path is the didactic reconstruction of Kant‟s rational project, from which, starting in its establishment, the juridical-political concepts that culminate in the state configuration conducive to the adequate development of the State and its powers are analyzed. Therefore, this work addresses, from the examination of the individual apart from the State, that is, issues related to natural rights and the project of forming a people, to its concretization, with the deduction of the principles that will base the legal system and outline its institutions. In the end, four fundamental factors are proposed for the legitimacy of the republic, namely, i.) the freedom of man as a natural right; ii.) the moral obligation of men to organize themselves in a State; iii.) the establishment of the Rule of Law; and iv.) the conformity of positive law with natural law.
