Solo criado é uma solução jurídico-urbanística para a cidade? : estudo em Porto Alegre/RS (2000-2015)

Abstract

O presente trabalho refere-se ao instrumento jurídico-urbanístico chamado solo criado (SC) e à sua contribuição no processo de direção da expansão e construção da cidade de Porto Alegre/RS. Esta dissertação abrange o período compreendido entre os anos de 2000 e 2015 e visa identificar as experiências internacionais do SC, sua aparição no Brasil, dando ênfase ao surgimento e desenvolvimento desse instrumento no município brasileiro de Porto Alegre/RS. O presente estudo demonstrará como se deu o desenvolvimento e o manejo do SC em Porto Alegre, apresentando a evolução das formas legislativas que regraram o instituto do solo criado. Serão demonstradas, ainda, a fórmula matemática utilizada para o cálculo dos valores do SC no período entre 2000 e 2015 e a atual fórmula matemática aplicada por Porto Alegre. Por fim, a dissertação responderá à pergunta-título do estudo, ponderando se a utilização do SC valeu a pena ou não para o município de Porto Alegre/RS. O solo criado é um instituto jurídico-urbanistico que busca auxiliar o crescimento mais justo e igualitário da cidade. Seus maiores objetivos são tornar o crescimento urbanístico harmônico por meio da direção da expensão da cidade e gerar os recursos necessários para viabilizar a habitação de interesse social e demais necessidades urbanísticas aplicadas ao município de Porto Alegre.

The present work refers to the legal-urban instrument called soil created (SC) and its contribution to the process of directing the expansion and construction of the city of Porto Alegre / RS. This dissertation covers the period between the years 2000 and 2015 and aims to identify the international experiences of SC, its appearance in Brazil, while also emphasizing the emergence and development of this instrument in the Brazilian Municipality of Porto Alegre /RS. The dissertation will demonstrate how the development and management of SC in Porto Alegre took place, presenting the evolution of the legislative forms that governed the institute of the created soil. It will also be demonstrated the mathematical formula used to calculate the SC values in the period between 2000 and 2015 and the current mathematical formula applied by Porto Alegre. Finally, the dissertation will answer the question whether the use of SC was worthwhile or not for the Municipality of Porto Alegre /RS. The created soil is a legal-urbanistic institute that seeks to help the fairer and more equal growth of the city. Its main objectives are to make urban growth harmonious through the direction of the city's expense, generating the necessary resources to enable social housing and other urban needs applied to the municipality of Porto Alegre.
