Os valores supremos no Estado democrático de direito

Abstract

O trabalho tem por objeto material o estudo dos fins últimos do Estado, os valores supremos da sociedade brasileira, e outros valores que do coerência, equilíbrio, ajustamento à realidade sócio-jus-política e cultural da sociedade, identificados por SOUZA JUNIOR como valores relacionais. Dividido em três partes, inicia-se por uma visão geral, os valores supremos e a ordem sócio-política cultural, com um estudo tendo como ponto de partida a Pessoa Humana, o surgimento da sociedade e organização do Estado Democrático de Direito, os fundamentos jus-políticos do Estado. A segunda parte versa a respeito dos valores supremos no constitucionalismo ocidental moderno, iniciando por um estudo dos valores no Direito Constitucional Comparado, e dos valores superiores positivados na Constituição Espanhola de 1978. Ainda, procura-se uma resposta a respeito da força do preâmbulo diante da norma Constitucional e a aplicação dos fins do Estado de Direito. Na terceira, e última parte, os valores supremos definidos pelo Legislador Constituinte no preâmbulo da Constituição - a liberdade, a segurança, o bem-estar, o desenvolvimento, a igualdade e a justiça - encontram-se positivados como direitos individuais e sociais. E os valores relacionais do conjunto, ou integrativos – a fraternidade, a razoabilidade e a realidade. Por fim, os princípios político-constitucionais e princípios técnico-constitucionais. Assim, aqueles seis valores da ordem constitucional, valores fundamentais da sociedade fraterna, fundada na harmonia social, na ordem e solução pacífica dos conflitos. Este estudo, binômio direito e Estado, insere-se na Teoria Geral do Estado e no Direito Constitucional.

The present work is the study material object of last ends of the state, the supreme values of Brazilian society, and other values that give coherence, balance, adjusting the reality politic-jus-social and cultural of the society that SOUZA JUNIOR identifies as values relational. Divided into three parts, begins with an overview, the values supreme and cultural social-political order, with one study having as starting point the Human Person, the emergence of the society and organization of a Democratic State based on the rule of law, state’s fundamentals jus-political . The second part is about the supreme values in modern western constitutionalism, starting with a study of values in Comparative Constitutional Law, and superior values in the Spanish Constitution of 1978. Still seeking to find an answer about the strength of the preamble given the Constitutional standard and the application of the rule of law purposes. In the third and final part, the supreme values defined by the constitutional legislator in the preamble to the Constitution - freedom, safety, welfare, development, equality and justice, which are also found as individual and social rights. Furthermore, the relational values of the set, or integrative - brotherhood, reasonableness and reality, and finally, the political-constitutional principles and constitutional technical principles. So those, six values of the constitutional order, the fundamental values of fraternal society, founded on social harmony, order and peaceful conflict resolution. This study about direct binomial and State is part of the General Theory of State and Constitutional Law.
