A lei natural de acordo com o tratado da lei em Tomás de Aquino

Abstract

Este presente trabalho tem como principal objetivo tratar da noção de lei natural no Tratado da Lei, contido na Suma Teológica do filósofo Tomás de Aquino, representante da escolástica. O escopo passa pela própria noção de lei de acordo com o filósofo do período medievo e da lei eterna, imprescindível para que se possa entender o escopo abordado. O primeiro capítulo apresenta a visão de três comentadores sobre o Tratado da Lei, Ralph McInerny, John M. Finnis e Anthony J. Lisska, com o objetivo de esclarecer e problematizar questões pertinentes ao tema. O segundo capítulo tem seu foco direto nos artigos do Tratado da Lei para que a partir dos esclarecimentos dos comentadores se torne possível ter clareza sobre qual a teoria de Tomás de Aquino sobre a lei natural no Livro da Lei. Assim se pode ter uma visão clarificada sobre o pensamento do filósofo em relação ao tema do trabalho.

The main objective of the present work is to deal with the notion of natural law in the Treatise of Law of the Suma Theologica. The scope goes through the notions of law and eternal law, indispensable to understand the content addressed. The first chapter presents the vision of three commentators on the Treatise of the Law: Ralph McInerny, John M. Finnis and Anthony J. Lisska, with the aim of clarifying and discussing issues pertinent to the theme. The second chapter has its direct focus on the articles of the Treatise of the Law so that, based on the explanations of the commentators, it becomes possible to have a clear view on what Thomas Aquinas' theory on natural law is. Thus, we intend to offer an overview of the philosopher's thought on the subject of law.
