Acesso à informação e transmissão de conhecimento pelo uso de linguagem técnica : o caso das agências reguladoras

Abstract

As Agências brasileiras atuam na regulação de serviços públicos e atividades econômicas importantes para o desenvolvimento social e econômico do País. Algumas destas atividades são exercidas por particulares, assim, desde a década de noventa quando foram implementadas, tais entidades passaram a intervir em relações entre terceiros, por vezes relações de consumo. A estas autarquias especiais se aplica o dever de informar tutelado pela Constituição Federal, regulado por meio da Lei nº 12.527/2011 e do Decreto nº 7.724/2012. Com o objetivo de aferir a possibilidade de exercício do direito de acesso à informação do cidadão em relação aos atos praticados pelas Agências Reguladoras realizou-se estudo de caso procurando identificar no website da Agência Nacional de Energia Elétrica - ANEEL a disponibilidade de informações de forma clara e acessível de forma a possibilitar a um cidadão comum compreender o reajuste da tarifa de energia elétrica concedida à Distribuidora AES SUL, no ano de 2015, o que incluiu a análise da Audiência Pública 005/2013. Tanto no que tange às informações divulgadas para fins de participação na referida audiência pública, quanto às de caráter puramente informativo, disponibilizadas após definição do reajuste, constatou-se que apesar da divulgação de vasta documentação facilmente localizada no website, a linguagem utilizada é técnica, de difícil ou mesmo impossível compreensão por parte de leigos, comprometendo o exercício efetivo do direito à informação, da mesma forma que não promove de forma efetiva a participação popular direta no processo decisório.

The Brazilian Agencies act in the regulation of public services and economic activities important for the social and economic development of the country. Some of these activities are carried out by private agencies, so, since the nineties when they were implemented, these entities began to intervene in relations between third parties, sometimes consumer relations. To these special municipalities apply the duty to inform under the protection of the Federal Constitution, regulated by Law 12.527/2011 and Decree 7.724/2012. In order to assess the possibility of exercising the right of access to information of the citizen in relation to the acts practiced by the Regulatory Agencies, a case study was carried out seeking to identify on the website of the National Electric Energy Agency – ANEEL, the availability of information in a clear way and accessible in order to enable a common citizen to understand the readjustment of the electric energy tariff granted to the AES SUL distributor, in the year 2015, which included the analysis of the Public Hearing 005/2013. Regarding the information disclosed for purposes of participation in said public hearing, as well as those of a purely informative nature, made available after definition of the readjustment, it was found that despite the disclosure of vast documentation easily located on the website, the language used is technical, difficult or even impossible to understand by lay people, jeopardizing the effective exercise of the right to information, in the same way that it does not effectively promote direct popular participation in the decision-making process.
