Os precedentes vinculantes no CPC/2015

Abstract

O presente trabalho tem por objeto os precedentes vinculantes no contexto do Código de Processo Civil de 2015. O estudo consiste na análise das diferentes correntes doutrinárias a respeito do precedente vinculante a partir da divisão proposta por Ronaldo Cramer, que observa a interpretação de cada uma delas quanto ao artigo 927 do Código de Processo Civil. O tema é inicialmente abordado estabelecendo os conceitos preliminares que formam a ideia de precedente vinculante. A partir das delimitações coladas, a monografia se desenvolve através da análise de cada uma das cinco correntes doutrinárias divergentes propostas, expondo individualmente as suas teses jurídicas, quais decisões são por elas consideradas precedentes vinculantes e, por fim, os argumentos contrários a cada uma.

The object of the present paper is the binding precedent in the context of the Civil Procedure Code of 2015. The study consists of the analysis of different doctrinal currents about the binding precedent through the division proposed by Ronaldo Cramer, which observes the interpretation given by each one of them to the article 927 of the Civil Procedure Code. The theme is initially approached by establishing the preliminary concepts that form the idea of binding precedent. From the delimitations set, the monograph develops through the analysis of each one of the five divergent doctrinal currents proposed, individually exposing its juridical thesis, which decisions are considered binding precedents by them, and, at last, the arguments contrary to each one.
