Condicionantes sociais e jurídicos do acesso desigual ao esgotamento sanitário na cidade de Porto Alegre

Abstract

O esgotamento sanitário é um serviço público essencial nas cidades, considerando sua relação com o direito à moradia, o direito à saúde e o direito ao meio ambiente sadio. O presente trabalho apresenta um levantamento de informações referentes ao acesso ao esgotamento sanitário nas áreas irregulares do município de Porto Alegre. A finalidade do trabalho é avaliar se as áreas irregulares são negligenciadas na prestação de serviços públicos, analisando o ordenamento jurídico referente à matéria, os níveis socioeconômicos da população que habita essas localidades e suas características físicas. O levantamento dessas informações foi realizado por meio de coleta de documentos, como o Plano Municipal de Saneamento Básico, o Plano Municipal de Habitação de Interesse Social e os dados disponibilizados pelo Instituto Brasileiro de Geografia e Estatística (IBGE) e pelo Sistema Nacional de Informações sobre o Saneamento (SNIS). Como resultado do presente trabalho, foi possível averiguar que pessoas em áreas irregulares usufruem de serviços públicos completamente distintos no que tange à precariedade no acesso ou à diferença de qualidade nos serviços, sendo as populações negra e parda as mais afetadas por essa realidade desigual. Concluindo, a negligência por parte do Poder Público está relacionada também à irregularidade fundiária, que afeta não somente a estrutura física desses assentamentos irregulares, mas também a qualidade de vida de seus moradores e, consequentemente, os direitos humanos.

Sanitary sewage is an essential public service in cities, considering its relationship with the right to housing, the right to health and the right to a healthy environment. The present work presents a survey of information regarding access to sanitary sewage in the irregular areas of the city of Porto Alegre. The purpose of the study is to evaluate if irregular areas are neglected in the provision of public services, analyzing the juridical order referring to the matter, the socioeconomic levels of the population that inhabits these localities and their physical characteristics. The collection of this information was done through the collection of documents, such as the Municipal Sanitation Plan, the Municipal Social Housing Plan and the data provided by the Brazilian Institute of Geography and Statistics (IBGE) and the National Information System on sanitation (SNIS). As a result of the present study it was possible to verify that people in irregular areas enjoy completely different public services, in what concerns to the precariousness in the access or to the difference of quality in the services. The black and brown population are the most affected by this unequal reality. In conclusion, negligence on the part of the Government is also related to land irregularity, which affects not only the physical structure of these irregular settlements but also the quality of life of its residents, and consequently human rights.
