O abuso do direito e o artigo 187 do código civil de 2002 : uma análise doutrinária sobre o exercício inadmissível do direito subjetivo

Abstract

Trata-se de trabalho de conclusão de curso de graduação na área de direito civil, tendo como enfoque a análise legal e doutrinária do art. 187 do Código Civil de 2002 e da Teoria do Abuso do Direito. Busca-se analisar a evolução histórica da teoria do abuso do direito, com a interpretação jurídica dada pelos doutrinadores às épocas históricas sob uma perspectiva de desenvolvimento jurídico da teoria, nas quais seu desenvolvimento foi mais intenso, citando-se, ainda, os aspectos sociais que contribuíram para a sua evolução e que culminariam no seu reconhecimento doutrinário e legal atual no Brasil. As questões atinentes a formação e manifestação do abuso direito, bem como os aspectos sociais e jurídicos que modificaram sua compreensão e aceitação ao longo do tempo, são aspectos que se pretende esmiuçar. Analisa-se, ainda, as bases dogmáticas do art. 187 e como ele se relaciona com a doutrina do abuso do direito. Por conseguinte, cuida-se, esta monografia, de analisar o que a doutrina entende por abuso do direito hodiernamente no direito brasileiro, por meio de pesquisa dos conceitos que os doutrinadores contemporâneos atribuem ao nomem iuris. Sob um enfoque doutrinário, demonstra-se, também, como se caracteriza o abuso do direito, ao se desvendar o que é o exercício irregular e como ele se caracteriza, por meio do excesso manifesto dos limites das balizas firmadas pelo art. 187. Por fim, expõe-se os efeitos decorrentes do exercício abusivo do direito, e o caráter geral e abrangente que o art. 187 dá ao instituto estudado, atribuindo-lhe qualidade multidisciplinar.

The present paper is the coursework for degree in civil law , with focus on legal and doctrinal analysis of the art. 187 of the Civil Code of 2002 and the Theory of Abuse of Rights. It seeks to analyze the historical development of the theory of abuso of rights, the legal interpretation given by scholars to historical times under a legal development theory perspective in which its development was more intense, citing also the social aspects that contributed to its development and culminating in its doctrinal and legal recognition currently in Brazil. Matters relating to the formation and demonstration of the abuse of rights, as well as the social and legal aspects that changed it’s understanding and acceptance over time, are aspects that we want to scrutinize. We also analyze the dogmatic foundations of the art. 187 and how it relates to the doctrine of abuse of rights. Therefore, this monograph care to analyze the doctrine of abuse of rights in today’s times in Brazilian law, through research of the concepts that contemporary scholars attribute estou this nomem iuris. Under a doctrinaire approach, we demonstrate, too, how the abuse of rights is characterized, to unravel what is the irregular exercise and how it is characterized by manifest excess of the limits of the criteria assigned by the art. 187. Finally , the judicial effects that arise from the abusive exercise of the right, and the general and comprehensive attribute that the art. 187 gives to the studied instituition, by assigning it multidisciplinary quality, are exposed.
