Previdência complementar : fundos de pensão e a Funpresp/Exe

Abstract

O objetivo do presente trabalho é analisar as principais características do regime previdenciário complementar, em especial os fundos de pensão e a Fundação de Previdência Complementar do Servidor Público Federal do Poder Executivo (Funpresp/Exe). Analisou-se o conceito e as áreas de estudo do direito previdenciário: saúde, assistência social e previdência social. Analisou-se também alguns princípios do direito previdenciário, identificando-se o princípio da solidariedade como o princípio fundamental da seguridade social. Estudou-se as três modalidades de regimes previdenciários existentes em nosso ordenamento jurídico (regime geral de previdência social, regimes próprios de previdência social e regime previdenciário complementar), verificando-se as diferenças entre eles. Estudou-se ainda a divisão do regime previdenciário complementar em entidades abertas e entidades fechadas (fundos de pensão) e verificou-se suas principais características. Por fim, analisou-se a instituição da Fundação de Previdência Complementar do Servidor Público Federal do Poder Executivo (Funpresp/Exe) e suas consequências para os servidores públicos ingressantes a partir da sua criação

The objective of this paper is to analyze the main characteristics of the complementary social security system, especially the pension funds and the Federal Public Server Executive Branch (Funpresp / Exe). The concept and areas of study of social security law were analyzed: health, social assistance and social security. It also analyzed some principles of social security law, identifying the principle of solidarity as the fundamental principle of social security. We have studied the three types of social security regimes that exist in our legal system (general social security regime, own social security regimes and supplementary social security regime), and the differences between them are analyzed. It was also studied the division of the complementary social security regime into open entities and closed entities (pension funds) and verified its main characteristics. Finally, the institution of the Supplementary Pension Foundation of the Federal Public Servant of the Executive Branch (Funpresp / Exe) and its consequences for the public servants entering into force after its creation were analyzed.
