Recurso especial nº 1.070.896-SC: um caso de violação da convenção americana de direitos humanos

Abstract

Por meio deste trabalho, busca-se elaborar uma análise crítica do entendimento proferido pelo Superior Tribunal de Justiça no julgamento do Recurso Especial nº 1.070.896-SC. Será defendido que o precedente criado em tal ação judicial desconsiderou as regras protetivas que regem o instituto da tutela coletiva, prejudicando os vulneráveis de forma tão incisiva que representa afronta à Convenção Americana de Direitos Humanos. Para abordar o tema, dividiu-se o trabalho em duas grandes partes. Na primeira parte, será feita uma breve contextualização do precedente objeto desta pesquisa, o qual, em seguida, será analisado à luz do regramentos e fins do microssistema de tutela coletiva. Buscarse- á, com isso, demonstrar que a decisão do Recurso Especial nº 1.070.896-SC vai de encontro à ampliação da proteção aos vulneráveis, preconizada pelas ações coletivas. Na segunda parte da pesquisa, passa-se ao exame do tema sob o referencial do Sistema Interamericano de Direitos Humanos. Se defenderá que a decisão exarada no precedente em exame representa uma violação aos direitos fundamentais e, igualmente, à Convenção Americana de Direitos Humanos, em seus dispositivos que garantem o direito de acesso à justiça e a liberdade de associação. Por fim, será feita sucinta conclusão sobre o tema, ressaltando-se a sua relevância, seus efeitos e a necessidade de uma alteração do posicionamento sedimentado pela Corte Superior.

This work seeks to elaborate a critical analysis on the understanding rendered by the Brazilian Superior Court on the judgment of the Recurso Especial nº 1.070.896-SC. It will be argued that the judicial precedent created in that case disregarded the protective rules of class actions, harming the vulnerable part in such an incisive manner that it amounted to a violation of the American Convention on Human Rights. To address the issue, this research was divided in two parts. In the first part, a brief contextualization of the case will be developed, then the precedent will be analyzed in light of the rules and goals of class actions’ microsystem. It will be demonstrated, by that, that the decision on the Recurso Especial nº 1.070.896-SC goes against the broadening of the protection of vulnerable people, as recommended by class actions. In the second part, the subject will be studied on the scope of the Inter-American System of Human Rights. It will be argued that the decision in the case under analysis represents a violation of fundamental rights and, equally, of the American Convention on Human Rights, which grants the right to access to justice and freedom of association. Lastly, a succinct conclusion will be made on the subject, highlighting its relevance, its effects and the need for a change in the understanding stablished by the Brazilian Superior Court.
