Os reflexos da Lei n. 11.340/06 (Lei Maria da Penha) em matéria penal e processual penal

Abstract

Este trabalho tem como objetivo analisar o tratamento dado às mulheres ao longo dos anos, até a criação da Lei Maria da Penha, demonstrando que o preconceito para com o sexo feminino vem se perpetuando no tempo, apesar dos avanços já conquistados pelas mulheres. Ademais, pretende provar a necessidade da referida lei, bem como afastar os argumentos contrários à sua efetiva implementação. Além disso, visa a discutir as mudanças trazidas pela Lei 11.340/06 no que diz respeito tanto ao tratamento dado aos agressores quanto às vítimas. Pretende, também, estudar os tipos de violência abarcados pela Lei, bem como as formas de combate-las. Por fim, intenta traçar um panorama da violência contra a mulher no Brasil, demonstrando que é preciso dar visibilidade a esse problema que é responsável pela morte de milhares de mulheres todos os anos.

This study aims to analyze the treatment given to women over the years, until the creation of the Law Maria da Penha, demonstrating that the prejudice against women has been perpetuating over time, despite the advances already conquered by women. Furthermore, it intends to prove the necessity of the mentioned law, as well as to refute the arguments against its effective implementation. In addition, it aims to discuss the changes brought by Law 11.340/06 regarding both the treatment given to the aggressors and the victims. It also seeks to study the types of violence covered by the Law, as well as the ways of combating them. Finally, it tries to outline a panorama of violence against women in Brazil, demonstrating that it is necessary to give visibility to this problem that is responsible for the deaths of thousands of women every year.
