O artigo aborda duas políticas públicas educacionais voltadas à Educação Básica, cujos efeitos normativos possuem repercussões importantes para a Educação Infantil e para os anos iniciais do Ensino Fundamental. O artigo aborda duas políticas públicas educacionais voltadas à Educação Básica, cujos efeitos normativos possuem repercussões importantes para a Educação Infantil e para os anos iniciais do Ensino Fundamental. O fio condutor deste ensaio são as recentes alterações no ordenamento legal educacional brasileiro, na medida em que estas produzem efeitos sobre a oferta e organização dos processos iniciais de escolarização. Analisamos políticas referentes ao Ensino Fundamental de nove anos com ingresso aos 6 anos de idade e à obrigatoriedade de matrícula das crianças de 4 e 5 anos na Pré-Escola, destacando-se as interfaces curriculares entre ambas. A fundamentação teórico-legal do ensaio se sustenta na responsabilidade do Estado para com a oferta de educação escolar pública, gratuita, laica e de qualidade social (CURY, 2011; DUARTE, 2007), enquanto sua perspectiva analítica se apóia na abordagem crítico-reflexiva de interpretação dos documentos normativos (LIBÂNEO; OLIVEIRA; TOSCHI. 2008). As questões curriculares são tratadas com base em Pacheco (2003) e Arroyo (2011). Defende-se a necessidade de que o Brasil implemente políticas de Estado no campo educacional, considerando Educação Infantil e anos iniciais do Ensino Fundamental como um continuum no qual as crianças vivenciem experiências escolares significativas e desafiadoras, independente do ano ou etapa em que estejam matriculadas. ...

The article discusses two educational public policies focused on Basic Education, whose normative effects have important implications for early childhood education and the early years of elementary school. The leitmotif of this essay are the recent changes in the legal education system in Brazil, to the extent that these effects on the supply and organization of initial processes of schooling. We analyze policies for the basic education of nine years with admission since six years of age and the compulsory schooling of children aged four and five years in preschool, especially as the interfaces between the two levels. The theoretical-legal analysis is based on the responsibility of the state towards the provision of public school education, free, secular and with social quality (CURY, 2011; DUARTE, 2007), while his analytical perspective relies on critical and reflective approach interpretation of the normative documents (LIBÂNEO, 2008). Curricular issues are handled based on Pacheco (2003) and Arroyo (2011). It is argued that Brazil needs to implement state policies in the educational field, considering early childhood education and early years of primary education as a continuum in which children could experience significant and challenging school experiences, regardless of their ages or the level in with they were. ...
