O dever de prevenção do juiz

Abstract

O objetivo do presente trabalho é analisar o dever de prevenção do juiz, regra de conduta imposta pelo princípio da colaboração, a ser seguida pelo juiz na condução do processo. Sustentar-se-á, assim, que, com a passagem do modelo assimétrico para o modelo cooperativo, não mais se atribui ao juiz toda a iniciativa na condução do processo, mas se passa a defender que tal condução seja realizada em colaboração com as partes, de forma isonômica, vislumbrando-se a assimetria do julgador somente no momento da decisão. Neste contexto, as partes passam a influir na construção do provimento jurisdicional em igualdade de condições e de oportunidades, sendo a decisão judicial fruto da colaboração entre juiz e partes. Neste cenário, a fim de se viabilizar uma decisão de mérito justa e efetiva às partes (art. 6º do CPC/2015), a atuação do juiz é gravada pelos deveres cooperativos, dentre eles o dever de prevenção. Tal dever impõe ao julgador a necessidade de viabilizar à parte a possibilidade de sanar eventual defeito formal que seja capaz de obstaculizar o exame do direito material levado a juízo. Em decorrência disso, o dever de prevenção relaciona-se diretamente com as invalidades processuais, visto que almeja evitar a decretação destas e privilegiar o exame de mérito das questões levadas a juízo. Por fim, defender-se-á a efetiva incidência do dever de prevenção ao longo do procedimento comum do Código de Processo Civil de 2015, tendo em vista os inúmeros dispositivos que o encampam ao longo das fases processuais.

The objective of this study is to analyze the duty of prevention of the judge, rule of conduct imposed by the principle of collaboration, to be followed by the judge in the conduct of the process. It will be defended, therefore, that, with the transition from the asymmetrical to the cooperative model, it is no longer the judge's responsibility to initiate proceedings, but it is argued that such conduct should be carried out in collaboration with the parties, in an isomeric form, with the asymmetry of the judgment being seen only at the moment of the decision. In this context, the parties begin to influence the construction of the judicial system on equal terms and opportunities, and the judicial decision is the result of the collaboration between the judge and parties. In this scenario, in order to allow a decision of fair and effective merit to the parties (article 6 of the CPC / 2015), the judge's performance is recorded by the cooperative duties, among them, the duty of prevention. This duty imposes on the judge the need to enable the party to remedy any possible formal defect that is capable of hindering the examination of the material right brought before a court. As a result, the duty of prevention is directly related to procedural invalidity, since it seeks to avoid them and to privilege the examination of merit of the issues brought to court. Finally, it will defend the effective incidence of the duty of prevention throughout the common procedure of the Code of Civil Procedure of 2015, in view of the numerous devices that encamp throughout the procedural phases.
