A presente monografia tem por objetivo examinar o dever de aconselhamento das instituições financeiras, no âmbito das operações de crédito, em benefício dos consumidores. Para tanto, aborda-se o tratamento conferido pelo Código de Defesa do Consumidor (Lei nº. 8.078/1990) à informação: de direito básico do consumidor a dever imputável ao fornecedor, reveste-se de eficácia vinculante capaz de garantir sua efetividade. Ainda que numerosas as referências ao tema, em contextos diversos, o diploma legal se restringiu à disciplina de informações de natureza objetiva, como regra. Em vista disso, o segundo momento desta pesquisa se ocupa da análise do dever de aconselhamento, que consiste em um dos níveis do dever de informar, ao lado do esclarecimento e da advertência. Por meio do aconselhamento, a instituição financeira deve considerar as qualidades pessoais do contratante, previamente à concessão de crédito, oferecendo-lhe uma solução adequada às suas necessidades e às suas possibilidades: trata-se da dimensão subjetiva da informação. Por fim, explora-se a proposta legislativa de atualização do Código (Projeto de Lei do Senado nº. 283/2012), particularmente no que se refere ao aconselhamento como fator de prevenção ao superendividamento. Ao longo do trabalho, há referências doutrinárias e jurisprudenciais sobre a matéria, além de apontamentos à legislação pertinente ao tema. ...

This monograph aims to examine the financial institutions’ duty of advice, in the scope of credit operations, for the benefit of customers. In order to do so, it addresses the treatment of information under the Consumer Protection Code (Law no. 8,078/1990): from a basic right of the consumer to the duty attributable to the supplier, it acquires binding effect which ensures its effectiveness. Despite numerous references to this matter, in diverse contexts, the legal diploma has restricted itself to disciplining objective information, as a rule. In view of this, the second piece of this study is devoted to the analysis of the duty of advice, which represents one of the levels of the duty to inform, along with clarification and warning. Through counseling, the financial institution must consider the personal qualities of the contractor prior to the provision of credit, offering him a solution suited to his needs and possibilities; that represents the subjective dimension of information. Finally, the legislative proposal to update the Consumer Protection Code (Senate Bill no. 283/2012), particularly regarding the advice as an instrument for the prevention of over-indebtedness, is explored.
