Violações de domicílio praticadas por policiais no contexto da política criminal de guerra às drogas : o tratamento dado pelo Tribunal de Justiça do Estado do Rio Grande do Sul à exceção constitucional do flagrante delito

Abstract

A política criminal de guerra às drogas, baseada em discursos autoritários e maniqueístas, sustenta uma concepção de guerra dentro do paradigma do Estado de Direito. Como uma verdadeira guerra, o inimigo é identificado e a ele não são assegurados os mesmos direitos que possuem os demais cidadãos. A própria ordem jurídica cria uma espaço de exceção dentro de si para permitir o combate ao inimigo, existindo uma vinculação subjacente entre esse discurso de emergência e aquele que reconhece determinados indivíduos como subcidadãos. Nesse contexto, a formação social brasileira contribui para a identificação do inimigo social e legitima o desrespeito aos seus direitos fundamentais, especialmente a inviolabilidade do domicílio, prevista no artigo 5º, inciso XI, da Constituição. O anterior entendimento adotado majoritariamente acerca da exceção do flagrante delito permitia a ocorrência de abusos policiais, o que motivou o Supremo Tribunal Federal a superálo. A nova interpretação dada ao problema passou a exigir a existência de fundadas razões (justa causa) para legitimar o ingresso dos policiais no domicílio sem autorização judicial para tanto. Conforme o próprio julgamento, o conceito de fundadas razões deve ser preenchido pela jurisprudência, atividade que, no âmbito do TJRS, vem sendo realizada apenas pela Terceira Câmara Criminal. O órgão julgador revisou seu entendimento anterior sobre a violação de domicílio e passou a admitir novas possibilidades de ingresso domiciliar por policiais, o que significa a adoção de um conceito amplo de justa causa.

The war on drugs criminal policy, based on authoritarian and dualist discourses, supports a conception of warfare within the Rule of Law background. As a real war, the enemy is identified and for him, there's no guarantee of the same rights conferred for other citizens. The legal order creates a space of exception inside itself to allow the fight against the enemy, prevailing an underlying connection between this emergency speech and the one that recognizes certain individuals as sub-citizens. In this context, the Brazilian social formation contributes to the identification of the social enemy and legitimizes the disrespect of their fundamental rights, especially the inviolability of domicile provided for the article 5, section XI, of the Constitution. The previous understanding mostly adopted on the exception of flagrant crime allowed several cases of police abuse, which led the Supreme Federal Court to overcome it. The new interpretation given to the issue required the existence of well-founded reasons (due cause) to recognize the legitimacy of house entering by policemen without judicial authorization to do so. According to the judgment, the concept of wellfounded reasons must be filled by the jurisprudence, activity that is being carried out only by the Third Criminal Chamber, in the scope of TJRS. The chamber reviewed its previous understanding on the breach of domicilie issue and began to admit new possibilities of lawful entering by policemen, which means adopting a wider concept of due cause.
