Embora não se trate de uma preocupação recente, o atual estágio de desenvolvimento da tecnologia da informação trouxe novo interesse ao embate entre "liberdade de expressão e direito à informação" e "direitos da personalidade", sobretudo em sua roupagem mais nova: o direito ao esquecimento. São examinadas as origens desse conflito na cultura jurídica, casos destacados na doutrina, assim como os avances sociais que o colocaram – novamente – na ordem do dia. Por fim, é apresentado um retrato do momento atual da discussão sobre o direito ao esquecimento no Brasil: sua compatibilidade com as normas constitucionais, a interpretação dos tribunais superiores, seu reconhecimento no plano infraconstitucional e as iniciativas legislativas para colocar o país no mesmo nível de proteção de países desenvolvidos. Ainda que seja possível identificar o direito ao esquecimento no ordenamento jurídico brasileiro, sua discussão no país é muito limitada uma vez que as decisões excluem a Internet do seu âmbito de apreciação e a legislação existente ainda coloca entraves ao exercício do direito. ...

Though not a new-found issue, the current stage of information technology has brought a renovated interest to the clash between both "freedom of expression and right to information" and the "rights of personality", especially in its newest form: the right to be forgotten. The origins of the conflict in the legal culture and relevant cases are discussed as well as the social developments that put it – once again – in the order of the day. Though not a new-found issue, the current stage of information technology has brought a renovated interest to the clash between both "freedom of expression and right to information" and the "rights of personality", especially in its newest form: the right to be forgotten. The origins of the conflict in the legal culture and relevant cases are discussed as well as the social developments that put it – once again – in the order of the day. Finally, it is presented a picture of the current moment of the discussion about the right to be forgotten in Brazil: its compatibility with constitutional norms, interpretation of the higher courts, its recognition in the infra constitutional law and the legislative initiatives to put the country at the same level of protection of developed countries. Although it is possible to identify the right to be forgotten in the brazilian legal system, its discussion in the country is very limited since the decisions exclude the Internet from its scope of appreciation and the existing legislation still hinders the exercise of this right. ...
