A invenção do inimigo e sua presença no direito penal brasileiro, principalmente no direito penal juvenil

Abstract

O presente artigo busca apresentar o que seria o Direito Penal do inimigo, tese criada pelo alemão Günther Jakobs, mostrando as bases filosóficas que o levaram a criar essa teoria, bem como o seu entendimento sobre o Direito Penal, fazendo-o dividir os indivíduos em cidadão e inimigo. Junto a isso, será demonstrada a incompatibilidade do Direito Penal do inimigo com o Direito Penal contemporâneo, principalmente no que diz respeito aos adolescentes, fazendo-se uma comparação entre alguns pontos desses dois Direitos, complementando com algumas críticas apresentadas principalmente por E. Raúl Zaffaroni, evidenciando- se que a aplicação dessa teoria representaria um manifesto retrocesso penal.

The present article tries to present what would be the Criminal Law of the enemy, theory created by the german Günther Jakobs, showing the philosophical underpinnings that led him to create this theory, as well as his understanding of the Criminal Law, making him divide individuals into citizen and enemy. Additionally, it will be demonstrated the incompatibility of the Criminal Law of the enemy with the contemporary Criminal Law, principally when we talk about adolescents, making a comparison between some points of this two Laws, complementing with some criticism specially given by E. Raúl Zaffaroni, demonstrating that the application of this theory would represent a criminal setback.
