Língua e lei : Uma visão introdutória ao direito das minorias linguísticas

Abstract

Este trabalho objetiva apresentar um panorama acerca dos direitos das minorias linguísticas no cenário internacional, tema que vem apresentando crescente relevância no Brasil, porém ainda é pouco explorado no campo jurídico. O embasamento teórico envolveu considerável pesquisa bibliográfica, a fim de viabilizar a resposta ao questionamento que motivou a realização desta monografia, qual seja, a existência ou não de legislação internacional protetiva às minorias linguísticas. Essa pergunta implica reflexão sobre diversas outras questões que têm conexão imediata com o tema referido, como o significado de língua, linguagem, cultura, formação da identidade do indivíduo, formas de convivência de diversos grupos linguísticos dentro do mesmo território, direitos culturais e direitos linguísticos, as quais são abordadas no primeiro capítulo do trabalho. Em resposta à indagação inaugural, o estudo dedica-se, no segundo capítulo, a examinar brevemente cinco importantes tratados internacionais e a sua relação com os direitos das minorias linguísticas: a Carta das Nações Unidas, a Declaração Universal dos Direitos Humanos, o Pacto Internacional sobre Direitos Civis e Políticos, a Declaração Universal dos Direitos Linguísticos e a Carta Europeia de Línguas Regionais ou Minoritárias.

This research aims to present an overview on the rights of linguistic minorities in the international setting, a subject that has become more and more relevant in Brazil, even though it is still not much discussed in the legal field. A lot of bibliographic research was done in order to answer the inquiry that triggered this study, which is whether there are international treaties on the protection of linguistic minorities or not. This query implies deep thinking on several other questions which are directly connected to the subject of this paper, such as the concepts of language, culture, identity formation, policies on the coexistence of different linguistic groups in the same territory, cultural and linguistic rights, which are all discussed in the first part of this work. As an answer to the inceptive question, the second part of this research is dedicated to a brief analysis of five international treaties and their connections to linguistic minorities: the UN Charter, the Universal Declaration of Human Rights, International Covenant on Civil and Political Rights, the Universal Declaration of Linguistic Rights and the European Charter for Regional or Minority Languages.
