dc.description.abstract | A demanda pela gestação por substituição vem crescendo nas últimas décadas e, por se tratar de uma forma de reprodução, intimamente, atrelada a valores culturais, sociais e religiosos, tem enfrentado tratamentos jurídicos distintos. Tais divergências têm levado pessoas a buscarem por esses serviços reprodutivos no estrangeiro, o que, além de potencializar as incertezas quanto ao status jurídico de filiação, demandará a incidência do Direito Internacional Privado, em decorrência do contato com mais de um sistema jurídico. Os problemas gerados a partir desse fenômeno têm mobilizado diversos países e a comunidade internacional, no sentido de reverem as leis internas e criarem mecanismos de cooperação multilateral que possibilitem assegurar certeza quanto à situação legal do nascituro. À luz dessa realidade e da hipótese de que o Brasil, mesmo sem uma lei específica em matéria de reprodução humana assistida, possui marcos jurídicos suficientes para regular a gestação por substituição e assegurar a proteção do superior interesse das crianças que venham a nascer em decorrência do uso dessa técnica, o presente estudo tem por objetivo explorar como esse crescente fenômeno tem impactado a atribuição dos vínculos parentais e quais os possíveis caminhos a serem percorridos para uma tutela efetiva do interesse superior da criança. O caminho a trilhar passa pela análise da regulamentação de alguns países e de como eles vêm enfrentando o problema do turismo reprodutivo, do projeto da Conferência da Haia de Direito Internacional Privado de criação de um sistema de cooperação internacional em matéria de filiação e gestação por substituição, bem como da base jurídica existente no Brasil e dos projetos de lei em tramitação no Congresso Nacional. | pt_BR |
dc.description.abstract | The demand for surrogacy has increased in recent decades. Because it is a form of reproduction closely linked to cultural, social and religious values, it has faced different legal treatment. Such differences have led people to look for these reproductive services abroad, which in addition to enhancing the uncertainties regarding the legal status of parentage require the incidence of private international law, as a result of contact with more than one legal system. The issues generated by this phenomenon have mobilised several countries and the international community to revise domestic laws and establish multilateral cooperation mechanisms that ensure certainty about the legal status of the unborn child. In light of this reality and the assumption that Brazil, even without a specific law on assisted human reproduction, has sufficient legal framework to regulate surrogacy and ensure the protection of the best interests of the children that may be born as a result of this technique, the present study aims to explore how this growing phenomenon has impacted the parentage, and what are the possibilities to ensure the effective custody of the best interests of the child. The present study involves the analysis of the regulation of some countries and how they have been facing the problem of cross-border reproductive care, the Hague Conference on Private International Law which has a project to create an international system of cooperation regarding parentage and surrogacy as well as the existing legal base in Brazil and of the bills pending in Congress. | en |
