O superendividamento do consumidor e os impactos sobre o fornecedor de pequeno porte

Abstract

O presente trabalho de monografia tem como base o superendividamento do consumidor e o inadimplemento perante o pequeno fornecedor, tendo em vista o grande acesso ao crédito e a facilidade de contratar, desprovido dos deveres de informação prévia, de advertência e de cuidado, tanto do leigo (consumidor) como do expert (bancos e financeiras). O tema principal deste estudo esta focado no endividamento do consumidor através de contratos de crédito facilitados de todas as formas e o não cumprimento daquele perante os comerciantes de pequeno porte. Diante disso, analisaremos o superendividamento, a realidade do pequeno fornecedor, os contratos de crédito e como está sendo tratado tal fenômeno aqui no Brasil.

This monograph has as its base the consumer over indebtedness and the default with the small supplier, owing to the large access of credit and the easiness of contract, in absence of the previous information obligations, of warning and caution, both the laic (consumer) as the expert (banks and financiers). The main topic of this study is focused in the consumer indebtment through facilitated credit contracts in every way and non-compliance with small businesses. In face of this, we will analyze the overindebtment, the reality of the small supplier, the credit contracts and how this phenomenon is being dealt here in Brazil.
