A professora de Direito e militante antipornografia Catharine MacKinnon redigiu legislações restritivas à produção, distribuição e consumo de pornografia por alegar que esta constituiria violação dos direitos civis das mulheres, uma vez que seria responsável por subordiná-las e silenciá-las. Desde então, filósofas da linguagem têm analisado suas reivindicações sob a perspectiva da teoria dos atos de fala de Austin (1962) com o intuito de demonstrar que não se tratam de mera metáfora: a subordinação e o silenciamento invocados seriam legítimos. Neste trabalho, debruçamo-nos sobre a questão do silenciamento da recusa das mulheres em contextos sexuais, trazendo a concepção de silenciamento ilocucionário de Langton (1993) e Hornsby (1994) e investigando de que modo as noções de silenciamento comunicativo (Maitra, 2009) e de silenciamento comunicativo+ (McGowan, 2009) aprimoram a primeira. Verificamos, junto a Maitra, que o conceito de significado do falante (Grice, 1989) resolve algumas inconsistências presentes na teoria do silenciamento ilocucionário, embasando mais consistentemente os propósitos de MacKinnon. Além disso, constatamos a plausibilidade do silenciamento defendido por McGowan, que se daria não pela falta de reconhecimento das intenções do falante, mas pela ausência de sua autoridade. Finalmente, apresentamos considerações sobre a indústria pornográfica que indicariam seu papel na manutenção de cenários em que os silenciamentos mencionados são possíveis, tese que deve ser corroborada a partir de contribuições de áreas como a psicologia e a biologia. ...

The law professor and anti-pornography militant Catharine MacKinnon has drafted legislation restricting the production, distribution and consumption of pornography by claiming that it constitutes a violation of the civil rights of women, since it would be responsible for subordinating and silencing them. Since then, philosophers of language have analyzed her claims from the perspective of Austin (1962)'s speech act theory, in order to show that they are no mere metaphor: said subordination and silencing would be real. In this work, we explore the issue of the silencing of women's refusal in sexual contexts, introducing the idea of illocutionary silencing proposed by Langton (1993) and Hornsby (1994) and investigating the ways in which the ideas of communicative disablement (Maitra, 2009) and communication-plus silencing (McGowan, 2009) refine the first. We find, along with Maitra, that the concept of speaker's meaning (Grice, 1989) resolves some inconsistencies in the theory of illocutionary silencing, providing a more consistent grounding for MacKinnon's purposes. In addition, we observe the plausibility of McGowan's notion of silencing, which would occur not because of the lack of acknowledgment of the speaker's intentions, but because of the speaker's lack of authority. Finally, we present observations on the porn industry that point to its role in maintaining scenarios where the aforementioned silencings are possible, a thesis that should be corroborated by contributions from fields such as psychology and biology. ...
