Perícia contábil : estudo da qualidade do trabalho dos peritos sob a ótica dos magistrados de primeiro grau atuantes na justiça cível da cidade de Porto Alegre / RS

Abstract

Diante do crescimento da quantidade de cursos de graduação em contabilidade e da ausência de restrições significativas para atuação como perito judicial, essa pesquisa buscou avaliar a qualidade do trabalho dos peritos atuantes na Justiça Cível, utilizando para tal a opinião dos Juízes de primeiro grau de Porto Alegre / RS. A pesquisa, de cunho quantitativo, é descritiva e realizada mediante levantamento efetuado através de questionário. Os resultados evidenciaram necessidades de melhorias na objetividade dos trabalhos, visto que mais da metade dos entrevistados assim entendeu. Ainda, foram verificadas deficiências nos requisitos pertinentes ao uso excessivo de termos técnicos na redação, na carência de informações prestadas de forma circunstanciada e existência de opiniões irrestritas à matéria contábil. Esse estudo é indicado aos peritos que atuam no mercado, aos Magistrados, aos advogados, estudantes e professores das áreas contábeis e jurídicas.

Before the increase in the number of undergraduate courses in accounting and the absence of significant constraints to act as a legal expert, this research aimed to evaluate the quality of work of the experts working in the Civil Justice, using the views of Trial judges of Porto Alegre / RS. The research, of quantitative nature, is descriptive and carried out through a survey conducted by a questionnaire. The results showed improvement needs in the objectivity of the work, since more than half of respondents answered in that sense. Besides that, deficiencies were found in the requirements that denote the excessive use of technical terms in writing, the lack of information provided in detail and the existence of views without restriction to accounting matters. This study is indicated to experts that operate in the market, the Magistrates, lawyers, students and teachers of accounting and legal areas.
