dc.description.abstract | A inclusão do direito à moradia no rol dos direitos fundamentais contidos no artigo 6º da Constituição Federal deu força argumentativa à possibilidade de sua exigibilidade em face do Poder Judicíario, o que restou empiricamente evidenciado pelo aumento do número de ajuizamentos nesta seara – muito embora sua jusfundamentabilidade já estivesse contida no texto original promulgado em 1988. Este trabalho possui por escopo a verificação, por meio de revisão bibliográfica e, subsidiariamente, jurisprudencial, da possibilidade de exigir-se o cumprimento de prestações materiais derivadas do direito à moradia em face do Poder Judiciário. Inicialmente é realizada uma análise do direito à moradia quanto à sua positivação nas esferas internacional e constitucional, seguido de um exame do seu conteúdo normativo. Observa-se, a seguir, diferentes posições doutrinárias acerca da possibilidade de realização judicial dos direitos prestacionais, empregando para tanto o método dialético. Em seguida, estuda-se com mais profundidade a teoria dos princípios de Robert Alexy, considerada aqui como a mais adequada para a compreensão do busílis. Por derradeiro, analisa-se a questão da reserva do possível, que é a restrição mais corrente quanto ao direito à moradia, abarcando inclusive o entendimento do Supremo Tribunal Federal. | pt_BR |
dc.description.abstract | The inclusion of the right of housing in the list of the fundamental rights contained in the 6th Article of the Federal Constitution gave argumentative strength to the possibility of its enforceability by the Judiciary. That was empirically highlighted by the number of prosecutions associated to this right – nevertheless its fundamentability was already included in the original text promulgated in 1988. The scope of this study is to verify, by literature review and, subsidiarily, jurisprudential, the possibility of requiring the fulfillment of material benefits derived from the right to housing in the face of the Judiciary. First, an analysis of the right to housing in regard to their affirmation in international and constitutional spheres is made, followed by an examination of its normative content. After that, different doctrinal positions about the possibility of judicial realization of rights to provide are analyzed, using the dialectical method. Then we study more deeply Robert Alexy's principle theory, considered here as the most appropriate for understanding the main subject. Finally, the issue of the most common restriction on the right to housing, the limits of the possible, is explored, including the understanding of the Federal Supreme Court. | en |
