dc.description.abstract | É evidente o crescente número de acidentes de trânsito decorrentes da condução de veículo automotor por pessoa sob os efeitos do álcool. A quantidade ínfima de álcool ingerida altera consideravelmente as atividades psicomotoras do indivíduo. Nesse sentido, as companhias seguradoras apresentam negativa quanto ao pagamento de indenização securitária, uma vez que há cláusula expressa de exclusão de risco, por se tratar de agravamento de risco. A jurisprudência majoritária entende que este agravamento deve ser intencional, com a finalidade de o segurado receber o pagamento da indenização, além do fato de estar comprovado o nexo de causalidade entre a embriaguez e o sinistro. Esta comprovação, conforme entendimento atual, deve se dar por parte da seguradora, em função da inversão do ônus da prova previsto no Código de Defesa do Consumidor. Contudo, entende-se, no presente trabalho, que a intenção do agravamento se restringe à conduta agravante em si, sem transportar o ânimo deliberado de prejudicar o segurador. Ademais, no que tange ao nexo de causalidade, aqui também se entende que este está presente automaticamente quando há sinistro envolvendo condutor embriagado, não sendo necessária a referida comprovação do nexo, ou, se necessária, que o ônus probatório seja do próprio segurado. | pt_BR |
dc.description.abstract | It´s undeniable the increasing number of traffic accidents resulting from driving a motor vehicle by a person under the influence of alcohol. The smallest amount of alcohol consumed can significantly alter psychomotor activities of the individual. In this sense, the insurance companies have denied payment of insurance indemnity, once there is express provision for risk of exclusion, because it is likely to become worse. The majority jurisprudence considers that this increase in risk must be intentional, for the purpose of the insured to receive payment of compensation, other than the need evidence of the causal link between drunkenness and the accident. This evidence, according to current understanding, should be given by the insurer, due to the inversion of the burden of proof fixed in the Consumer Protection Code. However, it is understood, in this study, that the intention of aggravation must be restricted to aggravating the conduct itself, without carrying the deliberate encouragement of harming the insurer. Furthermore, with respect to the causal connection, here too it’s understood that it is automatically existent when there is sinister involving a drunk driver, hence unnecessary to prove the causal. | en |
