O presente trabalho de conclusão do curso de Especialização tem o escopo de apresentar um estudo a respeito dos Precedentes Judiciais à comunidade acadêmica em geral, não somente à comunidade jurídica. Por esse motivo, foi objetivada uma linguagem passível de compreensão pelos que não cursaram a faculdade de Direito, dado o fato de que o estudo acerca dos Precedentes Judiciais deve chegar ao alcance de todos os cidadãos brasileiros, por ser um elemento novo no ordenamento jurídico brasileiro. Com a entrada em vigor do Novo Código de Processo Civil, em março de 2016, o sistema de precedentes judiciais, utilizado nos países que seguem a tradição do common law, passa a integrar nosso sistema jurídico, da tradição da civil law, ao lado das já conhecidas súmulas e jurisprudência. Todavia, os precedentes com elas não se confundem. Os precedentes não se confundem com as súmulas porque eles consistem em razões que levam em consideração, na sua base, a apreciação de casos – originando-se diretamente dos julgamentos proferidos pelo Supremo Tribunal Federal e o Superior Tribunal de Justiça. Os precedentes também não se confundem com a jurisprudência porque serem sempre vinculantes, ao passo que a jurisprudência somente é vinculante quando formada em incidente de resolução de demandas repetitivas e em incidente de assunção de incompetência. Os precedentes são dotados de caráter transcendental, servindo como paradigma para decisões futuras. ...

This working conclusion of the Specialization course has the scope to present a study on the Judicial Precedent to the academic community at large, not only to legal community. For this reason, it was objectified a language capable of understanding by those who did not attend law school, given the fact that the study of the Judicial Precedent should come within reach of all Brazilian citizens, because is a new element in the Brazilian legal system . With the entry into force of the new Civil Procedure Code in March 2016, the system of judicial precedents, used in countries that follow the tradition of the common law, becomes part of our legal system, of the civil law tradition, beside the already known overviews and jurisprudence. However, the Judicial Precedent to them are not confused. The Judicial Precedent former should not be confused with the overviews because they consist of reasons that take into account in its base, the assessment of cases - giving up directly from the judgments delivered by the Supreme Court and the Superior Court of Justice. The precedents also not be confused with the jurisprudence because they are always binding, while the jurisprudence is only binding when made in the repetitive demands incident resolution and incompetence-taking incident. The precedents are endowed with transcendental character, serving as a paradigm for future decisions. ...
