As tutelas inibitória e de remoção do ilícito aplicadas ao caso Utresa

Abstract

Em outubro de 2006 foi configurada a maior mortandade de peixes em um rio gaúcho, sendo, nesta tragédia, contabilizada a morte de cerca de 80 toneladas de animais no Rio dos Sinos. Após o ocorrido, o Ministério Público do Estado do Rio Grande do Sul instaurou um inquérito civil que apurou uma série de irregularidades nos empreendimentos localizados próximos ao Rio dos Sinos. Dentre os investigados, a Central de Tratamento de Resíduos Industriais UTRESA foi considerada a maior responsável pelo desastre, uma vez constatadas dentre as atividades ilícitas desta empresa, valas de resíduos perigosos a céu aberto, tubulações clandestinas despejando efluentes líquidos sem tratamento nos arroios próximos e resíduos enterrados diretamente no solo, entre outras. Evidenciadas tais irregularidades no empreendimento, houve a intervenção do Ministério Público que, por meio de Ação Civil Pública, tomou diversas medidas para regularizar a Central de Tratamento, inclusive sendo designadas Auditorias Ambientais e nomeados Gestores Ambientais para fiscalizar as restrições e condicionantes ambientais.

In October 2006 was configured the largest fishes death in a river of Rio Grande do Sul, and, in this tragedy, the death accounted for about 80 tons of animals in the Rio dos Sinos. After the event, the Public Ministry of Rio Grande do Sul filed a civil investigation that found several irregularities in the ventures located near the Rio dos Sinos. Among those investigated, the Central Industrial Waste Treatment UTRESA was considered most responsible for the disaster, once found among the illegal activities of this company, ditches hazardous waste in the open, clandestine underground pipes dumping untreated effluents in the streams and waste buried directly in the ground, among others. Demonstrated such irregularities in the venture, was held an intervention of the Public Prosecutor who, via of Public Civil Action, has taken several steps to regularize the Treatment Center, being designated Environmental Auditing and named Environmental Managers to appointed to inspection the environmental restrictions.
