A presente monografia tem como objetivo a análise das teorias acerca da responsabilidade civil do empregador por acidente do trabalho: subjetiva e objetiva. A presente monografia tem como objetivo a análise das teorias acerca da responsabilidade civil do empregador por acidente do trabalho: subjetiva e objetiva. O método utilizado foi o dedutivo, e a técnica de pesquisa empregada foi a revisão bibliográfica, bem como análise jurisprudencial, normativa e principiológica. Em um primeiro capítulo são feitas breves considerações históricas acerca do trabalho, seguidas por uma análise legislativa pertinente ao acidente do trabalho no Brasil, explorando seu conceito e seus desdobramentos. O segundo capítulo explora o conceito, espécies, pressupostos, excludentes e função social da responsabilidade civil, dando ênfase à responsabilidade subjetiva, pautada na culpa e a objetiva, fundada no risco. O terceiro e último capítulo faz a junção dos conceitos de acidente do trabalho e responsabilidade civil, tendo início com uma análise constitucional e principiológica acerca da proteção do trabalhador, explorando, a seguir, a idéia de socialização dos riscos, pautada no fundamento de que todos perdem em decorrência do acidente do trabalho, contrapondo, posteriormente, a indenização acidentária com a comum. Por fim, ainda dentro do terceiro capítulo, pondera-se a aplicabilidade da teoria da responsabilidade objetiva, no que se refere a responsabilidade civil do empregador por acidente do trabalho, analisando posições doutrinárias, jurisprudenciais, bem como a necessidade de análise caso a caso dos infortúnios laborais. ...

This thesis aims to analyze the theories of liability of the employer for accidents at work: subjective and objective. This thesis aims to analyze the theories of liability of the employer for accidents at work: subjective and objective. The method used was deductive, and research technique used was the literature review and analysis of jurisprudence, normative and principled. In a first chapter brief historical considerations are made about the work, followed by an analysis of the relevant legislative work accident in Brazil, exploring its concept and its consequences. The second chapter explores the concept, species, assumptions, and exclusive social function of civil liability, emphasizing subjective responsibility, based on guilt and objective, based on risk. The third and final chapter is to merge the concepts of occupational accidents and liability, beginning with an analysis of constitutional and principled about worker protection, exploring, then, the idea of socialization of risk, based on the grounds that all lost due to occupational accidents, countering later compensation of accident with the common. Finally, still in the third chapter considers the applicability of the theory of strict liability, as regards the liability of the employer for accidents at work, analyzing doctrinal positions, case law, and the need for case by case analysis of labor woes. ...
