A CLT, através do art. 899, permite a execução provisória até a penhora. A CLT, através do art. 899, permite a execução provisória até a penhora. O presente trabalho tem por finalidade verificar a possibilidade de utilização do mecanismo da execução provisória quando presentes obrigações de fazer e de não fazer, o que importa superar o limite estabelecido pelo artigo citado. Para tanto, em um primeiro momento, realizou-se a definição da terminologia afeita ao tema, perpassando pelo conceitos de obrigação, modalidades obrigacionais na lei processual e as distinções existentes entre a execução provisória e a definitiva. Na mesma ocasião, realizou-se um estudo acerca da eficácia e dos efeitos da decisão judicial. Passo contínuo, analisou-se o panorama atual da execução provisória trabalhista frente às alterações havidas no âmbito do processo civil, defendendo-se, como instrumento de efetividade na prestação da tutela jurisdicional, a aplicação subsidiária do art. 475-O do CPC ao processo do trabalho. Ao final, utilizando os argumentos reunidos nos capítulos anteriores, defendeu-se o cabimento da execução provisória de obrigação de fazer e de não fazer, argumentando que, com a aplicação subsidiária do art. 475-O do CPC, a execução provisória satisfativa no processo do trabalho é uma realidade que se impõe. ...
