dc.description.abstract | O trabalho tem por objetivo analisar a existência, viabilidade e limites de um direito de investigar fatos e descobrir ou produzir fontes de prova pelos particulares. Para tanto, parte-se da noção de prova como direito fundamental das partes, e não como mero ônus, permitindo, dentre outras, as prerrogativas de busca e obtenção da prova. Procura-se demonstrar que essas prerrogativas podem ser postuladas isoladamente perante o Poder Judiciário, pois do contrário estaria limitado indevidamente o acesso à justiça. Nessa perspectiva, a investigação de que se vale a parte para apuração de possível direito violado, ou em vias de sê-lo, consiste em direito que garante ao seu titular, quando obstaculizado o exercício, a pretensão de demandar em juízo certas providências de instrução. Diante de tais concepções, analisa-se o sistema processual vigente, mormente as ações probatórias de justificação, exibição de documentos, arrolamento de bens e produção antecipada de provas. A conclusão alcançada é a de insuficiência da redação legislativa para amparar todas as hipóteses em que se faça necessário o acesso a fatos e à prova de forma autônoma. Sugere-se, então, a interpretação do texto legal de forma a compatibilizá-lo com a Constituição. Por fim, verifica-se a suficiência do possível novo texto legal constante do Projeto de Código de Processo Civil em tramitação no Congresso Nacional. | pt_BR |
dc.description.abstract | The work has by goal to analyze the existence, viability and limits of a right to investigate facts and to discover or to produce sources of proof by the private individuals. Therefore, it starts from the notion of proof as a fundamental right of the parties, and not only as an onus, allowing, among other, the prerogatives of search and obtainment of proof. It is tried to demonstrate that these prerogatives can be postulated isolatedly before the Judiciary Power, because otherwise would be incorrectly limited the access to the justice. In that perspective, the investigation that is utilized by the party to find out possible violated right, or about to be so, consists in right that guarantee to his holder, when hindered the exercise, the pretension of claim in judgment certain instruction providences. Before such considerations, it is analyzed the procedural system currently in force, especially the evidentiary actions of justification, exhibition of documents, listing of assets and anticipated production of proof. The conclusion achieved is the insufficiency of the legislative drafting to support all hypothesis in which is required access to the facts and to the proof autonomously. It is suggested, then, the interpretation of the legal text in order to make it compatible with the Constitution. Finally, it is verified the sufficiency of the possible new legal text in the Civil Procedural Code Project in progress in the National Congress. | en |
