Terceira via e terceiro setor : aspectos jurídicos e consequências para a política educacional brasileira

Abstract

Este artigo objetiva analisar as mudanças ocorridas no papel do Estado, no que se refere às redefinições entre o público e o privado e suas conseqüências para a democratização da educação no Brasil. As relações entre o público e o privado manifestam-se no período atual tanto no que se refere à alteração da propriedade (público não-estatal), quanto em relação ao que permanece na propriedade estatal, mas reorganiza os processos educacionais na lógica do mercado. Este texto vai destacar os aspectos jurídicos do terceiro setor em geral e em particular da parceria entre o sistema público de um município do Rio Grande do Sul com o Instituto Ayrton Senna.

This article aims to analyze the changes in the state‟s role, with regard to the redefinitions between public and private, and their consequences for the democratization of education in Brazil. The relation between public and private are manifested in the current period both in terms of ownership changing (public non-state), and in relation to what remains in state ownership, but rearranges the educational processes in the market logic. This paper will highlight the legal aspects of third sector in general and in particular the partnership between the public system of a municipality of Rio Grande do Sul with the Instituto Ayrton Senna.
